Washington My Health My Data Act Policy (“WA Health Data Policy”)

Scope of this Policy

If you reside in the State of Washington, this WA Health Data Policy supplements Daily Harvest's Privacy Policy and applies to “consumer health data” as defined by the Washington State My Health My Data Act (“Consumer Health Data”). Terms not defined in this WA Health Data Policy have the meaning ascribed to them in our Privacy Policy. 

 
Why We Collect and Use Consumer Health Data

While we don’t intentionally or directly collect or maintain Consumer Health Data, your selection of particular food products may or may not indicate your health status (“Product Selection Data”). We also do not seek to draw any inferences regarding your individual health status from your Product Selection Data. To the extent Product Selection Data is considered Consumer Health Data, it is covered by this policy. Daily Harvest may collect and use Product Selection Data in connection with your use of our Services for the purposes described in our Privacy Policy. These Services include, for example, presenting you with product choices and fulfilling your order pursuant to your product selection choices.  

Categories of Consumer Health Data


To the extent Product Selection Data is considered Consumer Health Data, the categories of personal Consumer Health Data, Daily Harvest collects is (a) that you were searching or browsing online, including on our website, www.dailyharvest.com, for a certain Daily Harvest food product that may have been advertised as offering support for people with a certain health condition, and (b) that you purchased a certain Daily Harvest food product that may have been advertised as offering support for people with a certain health condition.

 

Sources of Consumer Health Data

 

To the extent Product Selection Data is considered Consumer Health Data, we collect Consumer Health Data when you shop on our website and when you purchase Products from us. 

 

Sharing of Consumer Health Data + Categories of Third Parties Who May Receive Consumer Health Data
 

To the extent Product Selection Data is considered Consumer Health Data, we may share the categories of Consumer Health Data described above with Service Providers, which are outside organizations that help us provide the Services or perform business functions on our behalf (for example, to complete a transaction, including to ship your order, or provide any Service you have requested or authorized), to comply with legal obligations as described in our Privacy Policy, and in connection with a business transfer as described in our Privacy Policy. We do not “sell” your Consumer Health Data. To the extent Product Selection Data is considered Consumer Health Data, if we identify your browser or internet connection as originating from within the State of Washington, we will not lodge any cookies that electronically share any such data with third parties. To the extent Product Selection Data is considered Consumer Health Data, to the extent you place an order with us, you consent to the use of Consumer Health Data necessary to process your order. This includes, for example, physically selecting and shipping the Products ordered and maintaining a record of your order.

 

How to Exercise Your Rights

 

If you are a resident of Washington, to the extent Product Selection Data is considered Consumer Health Data, you have the right to access, delete, or withdraw consent as it relates to Consumer Health Data.

The rights described above are not absolute, and, in certain cases, are subject to exemptions and limitations. We may decline your request as permitted by law. We cannot process your request if you do not provide us with sufficient detail to allow us to understand and respond to it.

We need to verify your identity to process your requests to exercise your rights to access, delete, or withdraw consent described below, and we reserve the right to confirm your state residency. To verify your identity, we may require you to log into your Daily Harvest account if you have one, provide identifiers we can match against information we may have collected from you previously, confirm your request using the email address or telephone number used to make the request, provide government identification, or provide a declaration under penalty of perjury, where permitted by law. Your authorized agent may make a request on your behalf upon our verification of the agent’s identity and our receipt of a copy of a valid power of attorney given to your authorized agent pursuant to applicable state law. If you have not provided your agent with such a power of attorney, we may ask you and/or your agent to take additional steps permitted by law to verify that your request is authorized, such as information required to verify your identity and that you have given the authorized agent permission to submit the request.
